Terms and Conditions

Definitions and Interpretation

  • Reward Points means the Points earned as a result of other promotional or incentive programs offered. The Points earned by you for each Dollar spent at Maxrite®, or as varied from time to time in accordance with these Terms and Conditions.
  • Account means an individual who has applied for Account in accordance with the Terms and Conditions, whose customer account number has been accepted by Maxrite® Store.
  • Account means the state and associated benefits of being a Account of the Maxrite® Points Program.
  • Privacy Act means the Privacy Act 1988 (Cth)
  • Privacy Policy means the Maxrite® Privacy Policy published on the Maxrite® website
  • Points refer to monetary Points given to Account Holders as a consequence of purchasing behaviours, incentives and/or promotions. Account Holders are notified of Points via email and on invoices.
  • Maxrite® means Maxrite®.com.au online store.
  • Terms and Conditions means the Terms and Conditions applicable to Maxrite® Points Program as set out in this document, as may be amended from time to time.
  • References to dollar amounts are in Australian currency. All prices quoted in member communications include GST.

Who can become an Account Holder:

  • Maxrite® Points Program is a ("Program") managed and conducted by Maxrite®.com.au. In consideration of Maxrite® registering you as an Account Holder of the Program, you agree to be bound by the following Terms and Conditions which apply to all Account Holders of the Program. You are automatically a Account Holders if you have customer account in store or customer account online and are bound by these Terms and Conditions.

Account Holder Eligibility

  • Account Holder is open to a corporation, firm, partnership or any other legal entity.
  • Maxrite® reserves the right to decline a Account should they believe that the details provided are unauthorised, fraudulent or otherwise unlawful.
  • An eligible individual may apply for an Account by signing up and creating a customer account online at www.Maxrite®.com.au or at any Maxrite® store (including all required information).
  • Maxrite® reserve the right to not accept or to reject an application for an Account at its absolute discretion.
  • All Account Holders will be assigned a customer account number which will be used for identification purposes.
  • By using your Account you agree to the collection, use and disclosure of your personal information in accordance with the Privacy Policy, as amended from time to time.

    Transfer of Account

    • Accounts are not transferable.

      Acceptance of the Terms and Conditions

      • These Terms and Conditions will form a contract between the Account Holder and Maxrite®. The Account Holder is deemed to have accepted these Terms and Conditions upon signing up with a customer account on Maxrite® online or a customer account at a Maxrite® Store.

        Notice

        • We will use our best efforts to notify you of any material changes to your Account and these Terms and Conditions by provide notice in advance via The Maxrite® website or can be obtained by emailing online.sales@maxrite.com.au

          Cancellation

          • An Account Holder may at any time cancel his or her Account by emailing online.sales@maxrite.com.au requesting cancellation of your Account.

            How can I earn Points?

            • An Account Holder will earn Points for every full dollar spent during a Reward Points promotion
            • Upon the occurrence of an Eligible Transaction, Points will be automatically added to the Account Holders Points balance. Points will be available in the relevant Account instantly after the purchase is complete.

            Where Points cannot be earned

            • An item advertised in a concurrent promotion at a reduced sale price or with a Reward will be excluded from accumulating Reward Points.
            • Points cannot be earned on gift cards, selected non-stock items, Lay-Bys, Purchases where Points have been redeemed or repairs.
            • Exclusions: Reward points do not apply for non-stock items, items on Sale with concurrent promotional price reductions, clearance items.
            • Products eligible for Reward points will be advertised online with a "Reward Points Banner" located on the product listing.
            • Points cannot be accrued on purchases made with points.
            • Points are not transferable or redeemable for cash and will only automatically accrue to the Account.
            • In regard to lay-by sales, Points will be assigned to an Account once the lay-by has been finalized and paid for in full.

              How can I redeem my points?

              • There is no minimum number of Points required before you can redeem. Redemptions can be made in increments of cents.
              • All redemptions for Reward Points will be processed directly at the Maxrite® Store or Maxrite® Online.
              • You can appeal to have any expired points reinstated by emailing online.sales@maxrite.com.au or chatting online.
              • Points may be redeemed in a lay-by sale.

                Where can I redeem my points?

                • Reward points accrued for purchases made at Maxrite® online can be redeemed at Maxrite® online only.
                • Reward points accrued for purchases made at a Maxrite® Store can be redeemed at any Maxrite® store.

                  How are Points calculated

                  • Points can only be redeemed in a Maxrite® Store and presentation of identification is required unless stated otherwise.
                  • Points based Promotions may include specific offer terms and conditions, including expiry dates. These Terms and Conditions are to be read in conjunction with any additional conditions associated with Points.
                  • All Points have an expiry date as outlined in each specific sales event, at which point they will no longer be available. You may appeal to have expired points reinstated by emailing online.sales@maxrite.com.au
                  • Only Points from one Account can be presented per transaction.

                    When will the points expire?

                    • Points expiry dates are subject to vary for each specific sale event, the expiry dates will be outlined in all promotional material at each specific sale event.
                    • Points will typically expire 3 years after the date of last Eligible Transaction unless otherwise specified.
                        • Supplier Roadshows points will expire 3 years after the date of last Eligible Transaction.

                      Returns and Exchanges

                      • Any returns of items used to earn Points will cause a deduction of the points earned during the original purchase. If you have redeemed your points before returning the product, you will be refunded the purchase value minus the equivalent monetary value of the Points (to the nearest dollar) used in the original transaction.
                      • Refund or exchange of redeemed items will only be provided in accordance with the Maxrite® Customer Friendly Refund Policy, please see https://Maxrite.com.au/pages/returns-warrantyfor more details.
                      • If a redeemed item is returned because it is faulty, a Maxrite® store will need to assess whether the fault is a major or minor fault and will organize an appropriate remedy. Please note, if necessary, products may be sent to the manufacturer for assessment to determine if they are faulty.
                      • The time frame for any exchange or refund is at the discretion of the Maxrite® Store.

                        Indemnity

                        • The Account Holder indemnifies Maxrite® in relation to any claim against Maxrite® and for any liability or loss suffered by Maxrite® or arising from or in connection with these Terms and Conditions.

                        Limitation of Liability

                        • To the extent permitted by law, Maxrite® is not liable for any Points and/or benefits not being available for any reason whatsoever. In addition, and without limiting the foregoing, to the extent permitted by law Maxrite®, is not liable for a member’s failure to notify the Maxrite® Store of their Membership and entitlement to Points.
                        • If any services provided to a Member by Maxrite® or the Maxrite® Store under these Terms and Conditions are within the scope of the Australian Consumer Law set out in Schedule Two of the Competition and Consumer Act 2010 (Cth) (“ACL”) then, subject to the provisions of the ACL, a number of guarantees will apply in respect of the services under the ACL including:
                        • The services being rendered with due care and skill;
                        • The services being fit for the purpose for which the services are being acquired, any disclosed purpose or being capable of achieving any disclosed result; and
                        • The services being supplied within a reasonable time.
                        • Maxrite® do not offer any other guarantees other than those contained in the consumer guarantee provisions of the ACL.

                        Maxrite® and any of their officers, employees or agents are not liable for any loss or claim of any kind (including, without limitation, consequential or economic loss or loss of profits), arising under or in connection with these Terms and Conditions or the Program including, without limitation, any changes to the Terms and Conditions or the Program, save to the extent that such loss or claim arises from the negligence or willful misconduct of Maxrite® or a Maxrite® Store, or any of their officers, employees or agents.

                        How will Maxrite® be collecting, using and disclosing my personal information?

                        • Maxrite® understand the importance of the privacy of an individual’s personal information. Maxrite® may collect and use personal information for the purpose of providing members with access to our business activities, including our promotional activities and administering your Account and involvement in the Program, or as required by law.
                        • We collect, use and disclose your personal information in accordance with the Points Program Privacy Policy ("Privacy Policy"), which forms part of these Terms and Conditions. Maxrite® may amend the terms of the Privacy Policy from time to time in accordance with these Terms and Conditions. In handling personal information, Maxrite® and the Maxrite® Store will comply with the Privacy Act.
                        • By registering as an Account Holder or by using your Account benefits, you acknowledge that you have read the Privacy Policy, and understand and agree that we will collect, use, store and disclose your personal information in accordance with its terms, as amended from time to time.

                        Who do I contact if I have feedback, or enquiry?

                        • If an Account Holder wishes to lodge feedback or an enquiry, they can notify a Maxrite® Store, go online and email online.sales@maxrite.com.auor chat online.
